Where is the criminal case against the son of the Prime Minister’s chief of staff, who faces up to seven years in prison for allegedly taking a man’s life after running him over with his car
Almost two months after the announcement of a road accident involving the son of the head of the Prime Minister’s office, Dorin Recean, Serghei Diaconu, in which one person died, the case is still at the criminal prosecution stage, and he has not yet been charged, but has been admitted as a suspect. According to the law, he faces up to 7 years in prison and the cancellation of his driving licence.
At the request of ZdG, representatives of the Prosecutor General’s Office (PG) said that no preventive measures had been taken against the 19-year-old.
“At the moment, preventive measures are not applied. The appropriateness of their application will be decided by the case prosecutor,” said PG spokeswoman Violina Moraru.
According to the PG, the criminal case was initiated on the basis of Article 264 paragraph (3) letter b) of the Criminal Code – “violation of traffic safety rules by the person driving the means of transport, a violation that caused the death of a person by negligence”, which is punishable by imprisonment from 3 to 7 years, with the cancellation of the right to drive means of transport.
“On the fact of the road accident occurred on July 16, 2023 on Calea Ieșilor Street in the capital, a criminal case was initiated, according to the constitutive elements of the crime of “violation of traffic safety rules by the person driving the means of transport, violation that caused the death of a person by negligence” (Article 264 paragraph (3) letter b) of the Criminal Code). Criminal proceedings are under way. The suspect has been interviewed, witnesses have been identified and interviewed, video recordings have been taken and expert opinions have been ordered. The criminal prosecution body is still carrying out all the relevant actions for a fair resolution of the case”, Violina Moraru said.
Serghei Diaconu’s son drove his car over a man on Sunday evening, 16 July. The man subsequently died. The announcement was made at the time by the head of the prime minister’s office on his Facebook page.
He said the victim was intoxicated.
“Last night, when entering a residential courtyard, the car driven by Cristian ran over an intoxicated man who was lying on the pathway to the courtyard. After getting out of the car and seeing the injured person, he immediately called 112 and requested the ambulance and the police. The man was still alive when the ambulance arrived, but later died,” the message said.
Police said the accident took place on July 16, 2023, at around 10:54 p.m.
“At the scene, police officers determined that a 19-year-old male, driving a Toyota model car, ran over a man with his car. As a result of the trauma received, the man subsequently died,” police wrote in a summary.
